in Police Negligence
The attorneys at Javerbaum Wurgaft Hicks Kahn Wikstrom & Sinins are strong supporters of our local and state police officials and recognize the difficult and dangerous job they perform everyday. The firm also recognizes that these officials are professionals and must conduct themselves accordingly. Although police officers should not be second guessed for the adverse consequences of a good faith exercise of judgment, law enforcement officers, like any professional, must be held accountable for conduct that deviates from proper police procedures. In those select cases, the attorneys at Javerbaum Wurgaft Hicks Kahn Wikstrom & Sinins have not hesitated to represent victims of police negligence or other misconduct.

DEFENDANT VERDICT/SETTLEMENT
CITY OF ROSELLE PARK POLICE Ken Javerbaum obtained a $450,000 settlement for two young girls struck by a car being chased by police proving that the police failed to follow proper high-speed pursuit guidelines.
NEW JERSEY STATE POLICE Ken Javerbaum obtained a $450,000 verdict on behalf of the estate of a woman who was killed when she stopped and then proceeded through a stop sign where she was struck by a state trooper. Through accident reconstruction, the firm proved that the trooper was traveling well in excess of the speed limit and was thus responsible for the collision even though the women had the stop sign.
NEW JERSEY STATE POLICE Bob Hicks obtained a $250,000 settlement for a truck driver injured when he was pulled out of his truck by a state trooper, proving that the trooper deviated from proper police procedure in stopping the trucker.
NEW JERSEY DEPARTMENT OF CORRECTION Bob Hicks obtained a confidential settlement with the State Department of Corrections on behalf on a State prison inmate for failure of the Department to protect the inmate from a brutal assault by a prison guard, proving that prison supervisors should have known prior to the assault that the guard in question was a dangerous individual.
